TRIAL TRANSCRIPT FOR SEPT 8, 2006 COURT HEARING

On September 8, 2006 at 9:30 a.m., Barry A. Bachrach, Esq. and Michael Kuzma, Esq. argued before United States Magistrate Judge Susan R. Nelson for the full release of all FBI files maintained by the Minneapolis Field Office relating to Leonard Peltier and RESMURS. The Court greeted both Leonard Peltiers’ attorneys and the government attorney with many questions and we ask that Leonard’s supporters pray that the Court make the just and right decision. After listening to the parties arguments the Court took the case under advisement and a decision will most likely be rendered within the next three months.

A Special Message from Leonard Peltier:
Greetings Sisters, Brothers, Friends and Supporters!
Well here it is another year. Another birthday. This one makes me 62 years old. Also this makes it my thirty plus years in prison. I believe it was right after I was illegally convicted in Fargo, North Dokota when I wrote a statement telling everyone that my freedom would only come after the masses had demanded it. But first we would have to unite and organize, to reach them.
So far we have been unable to do so. Yes we have reached millions who have signed my petitions we have circulated throughout the world asking for my release. True most of those good peoples are from Europe, but we have also made a lot of gains here in the United States. At one time we had fifty five (55) members of Congress sign a letter for a new trial or my release. Fifty-five members is historical. No other prisoner in history has ever been able to accomplish this, nor has anyone else, individually I mean, and there are other accomplishments we have made and won here in the United States. Still I sit in prison not because I am guilty of the alleged crime I was illegally convicted of but because we still are unable to reach the masses here in America. The reason for this is not because the American people do not care or want to help, but because we have been unable to reach them. Personally I believe the majority of them do care and want to help. We sense this from the ones we are able to reach. We are moving forward very slowly in this freedom campaign of mine. The reason is we just do not have the financial resources to move forward at the pace we would like to be. This is the real and only reason that we have not been able to reach the people in the United States. Nothing is free here in America, not justice or the media. So although there is still no light at the end of the tunnel for me or my freedom, we continue struggling forward. I continue to search for the hope and strength I need to survive. I continue to pray and hope that one day I will get the support I need from the American people and one day I will still be able to walk out of prison. So my hopes and spirits are still high at my 62 years of age. I continue on this continued struggle. We are still finding bits and pieces of new evidence to file new appeals on. Those of you who have followed my case closely I can imagine are thinking How can this be, as there has been so many constitutional violations already. But the same old problem exists. The courts continue to cover up the continued criminal acts of my conviction committed by my prosecutors.

SWITZERLAND:
Manitu free acoustic concert for Leonard’s birthday!Singer songwriter Mannalia and rock band Manitu will celebrate Leonard’s birthday by offering a free acoustic concert on Friday September 15th at 10.00 pm at café-restaurant “les Deux-Clées” in Porrentruy, Jura, Switzerland. The band will also perform the song “ Red Child ” written in honor of Leonard and of all Indian people. Mannalia will present Leonard’s story to the audience and will invite people to read Leonard’s “Prison Writings” and to contribute however they can. Flyers telling about Leonard’s story and LPDC will be handed out during the evening and a newsletter will be sent out to the band’s mailing list prior to the concert. The local Newspaper and radios will announce and present the event. On Friday morning Mannalia and guitar player/songwriter/producer David Grillon, will give a radio interview on Leonard’s situation and perform an acoustic song live for Leonard’s birthday. Leonard Peltier Court Hearing On September 8, 2006

On September 8, 2006 at 9:30 a.m., Barry A. Bachrach, Esq. and Michael Kuzma, Esq. will be arguing before U. S. Magistrate Judge Susan R. Nelson for the full release of all FBI files maintained by the Minneapolis Field Office relating to Leonard Peltier and RESMURS. The FBI reviewed 77,149 pages and released 66,594 pages in full or in part, however, 10,555 pages were withheld in their entirety. The government is fighting vigorously to prevent these documents that date back over 30 years, from being publicly released. Among other things, the FBI claims that the release of this information would harm national security and reveal the identities of confidential sources. The hearing is open to the public.

ORLANDO ROCK BAND and Friends will be observing Leonard's Birthday by lighting candles and saying prayers for his release and well-being on September 12th.

For Leonard's birthday, we will be having a cookout, and showing documentaries. Give our love and prayers to Leonard from everyone at the Warren, Ohio group. We will continue to do what we can to help our brother.

LEONARD PELTIER, one of America’s longest serving political prisoners, will turn 62 years old September 12. He has spent 30 years of his life behind bars for a crime he didn’t commit—in one of the most infamous cases of political persecution in modern U.S. history.
On September 8, Peltier’s lawyer Barry Bachrach will argue in federal court for the full release of all files maintained by the FBI’s Minneapolis office relating to Peltier.
Peltier was an active member of the American Indian Movement (AIM) in the 1970s. He was framed for the murder of two FBI agents on the Lakota Sioux Pine Ridge reservation in June 1975.
AIM was a major focus of the FBI’s notorious Counter Intelligence Program
(COINTELPRO) of the 1960s and ’70s, which attempted to "neutralize" the leadership of civil rights and revolutionary political organizations.
Two other AIM members, Bob Robideau and Dino Butler, were also indicted with Peltier, but were found not guilty after a federal trial in July 1976.
Peltier, who had fled to Canada to avoid prosecution, was later extradited to the U.S. and stood trial separately—he was found guilty of murder and sentenced to life in prison.
Peltier’s extradition from Canada and trial in the U.S. was rife with coerced testimony, manufactured evidence and prosecutorial misconduct. Lynn Crooks, one of Leonard’s prosecutors, admitted in 1985, "We can’t prove who shot those agents." Yet Peltier remains in prison because of the determined—even fanatical—efforts of the FBI.
So far, the FBI has released, partially or fully, 66,594 out of 77,149 pages related to Peltier’s case. The other 10,555 pages were withheld from Peltier’s defense team and could potentially provide crucial information in the campaign to free him.
The FBI has refused to release the additional pages on the grounds of "national security." Why a 61-year-old grandfather who has been behind bars for three decades and is plagued by chronic illness is a threat to national security has not been fully explained.
A look at the Minneapolis FBI’s Web site gives an idea of the agency’s strange view of the world—many times more space is devoted to Peltier and AIM than to Osama bin Laden.
In the waning days of the Clinton administration, when an effort was made to secure a presidential pardon for Peltier, hundreds of FBI agents responded by picketing the White House. Clinton backed away from a pardon. Since September 11, federal prison authorities have refused media access to Peltier. He has been unable to give an interview to the media in over five years. Only his legal counsel and a small number of supporters and family members can meet with him.
The FBI’s latest actions are symbolic of its 30-year persecution of Peltier and his supporters—and are perpetuating a terrible injustice.
